ORAL ORDER
17-08-2026
1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 324(4), 303(2), 351(2) and 3(5) of the B.N.S., 2023.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no.1 is a woman and the informant alleges that on 26.04.2026, accused persons including the petitioners came to his shop and abused, further Pankaj assaulted by rod causing injury on chest, thereafter petitioner no.2 assaulted by leg causing injury on nose Patna High Court CR. MISC. No.53726 of 2026(2) dt.17-08-2026
and he became unconscious, while petitioner no.1 and Sneha vandalized the shop causing loss of goods worth Rs.50,000/- and fled with Rs.35,000/-.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the FIR, it would manifest that the date of occurrence is 26.04.2026 and the FIR came to be instituted on 02.05.2026 i.e. after a delay of more than five days, which casts an aspersion on the case of the prosecution. It is also submitted that petitioner no.1 came to be implicated only with an intent to coerce the male members into submission. It is next submitted that as far as petitioner no.2 is concerned, he is alleged to have assaulted the informant by leg causing injury on nose but then there is no corroborating injury though one of the injury suffered by the informant has been opined to be grievous in nature but then from perusal of Para-6 of impugned order, it would manifest that a fracture in the 9th right side of rib of the informant is recorded and the said injury is alleged to have been caused by Pankaj.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned Patna High Court CR. MISC. No.53726 of 2026(2) dt.17-08-2026
counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Goreyakothi P.S.
