ORAL ORDER
14-08-2026 Heard learned counsel for the petitioners and learned APP for the State.
2. Learned counsel for the petitioners seeks permission to withdraw this bail application in respect of petitioner no. 2, namely, Durgesh Kumar.
3. Permission is accorded.
4. This application is dismissed as withdrawn in respect of petitioner. 2.
5. The instant application for anticipatory bail has been filed by the petitioner no. 1 apprehending his arrest in connection with Dariyapur P.S. Case No. 713 of 2025 instituted for the offence under Sections 126(2), 115(2), 118(1), 109, 103, Patna High Court CR. MISC. No.43074 of 2026(2) dt.14-08-2026
352, 351(2), 303(2), 324(2), 3(5) of the B.N.S., 2023.
6. The case of the prosecution, in short, is that the petitioner, along with 11 other named accused persons, arrived at the door of the informant and started abusing him. It is alleged that all the accused persons thereafter assaulted the informant. Specific allegations have been levelled against Satta Rai @ Sumant Rai, Bihari Rai and Sukul Rai of assaulting the informant. It is further alleged that Ajit Kumar assaulted the informant with a rod and Srikant Rai also assaulted him with a rod.
7. Learned counsel appearing on behalf of the petitioner no. 1 has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He also submits that the nature of allegation against this petitioner is general and omnibus. There is no specific allegation against the petitioner. He further submits that a statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.
8. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner no. 1.
9. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Patna High Court CR. MISC. No.43074 of 2026(2) dt.14-08-2026
Court is inclined to enlarge the petitioner no. 1, namely, Sukul Ray on bail. The petitioner no. 1 is directed to surrender in the Court below and in the event of his arrest or surrender in connection with Dariyapur P.S. Case No. 713 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran at Chapra subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
