ORAL ORDER

13-08-2026

1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 272, 273, 188 and 420 of the Indian Penal Code and Sections 38, 41 (i)(ii) and 30(a)(b)(c) of the Bihar Excise Act.

3. The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and allegation is of recovery of 3615 liters of liquor from a truck.

4. The learned counsel for the petitioner submits that petitioner was not apprehended from the spot, as such, Patna High Court CR. MISC. No.55767 of 2026(3) dt.13-08-2026

nothing was recovered from his conscious possession and he came to be implicated based on the fact that he is owner of the seized truck, but then he sold the truck to one Sandeep and Sandeep was also arrested from the place of occurrence.

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioner and submits that petitioner has been made an accused since he is owner of the seized vehicle. It is also submitted that if it is believed that Sandeep had purchased the truck from the petitioner, in that event, Sandeep would be an accused, but in absence of transfer of the vehicle in the name of Sandeep whether it would be prudent for the Court to record an order that the vehicle was sold to Sandeep. It is also submitted that it might be a ploy of the petitioner to seek anticipatory bail by hoodwinking the law. The learned A.P.P. further submits that the Court is lenient in granting anticipatory bail in cases relating to Excise, but when a person tries to hoodwink the law, the Court should not be lenient.

6. Considering the submissions made by the learned APP for the State, the Court is not inclined to Patna High Court CR. MISC. No.55767 of 2026(3) dt.13-08-2026

extend the privilege of anticipatory bail to the petitioner.

7. Accordingly, the instant anticipatory bail application stands rejected.
