ORAL ORDER

13-08-2026 At the outset, learned counsel for the appellants seeks permission to withdraw this appeal in respect of appellant nos. 1, 2, 4 & 6.

2. Permission is accorded.

3. The appeal stands dismissed as withdrawn in respect of aforesaid appellants. Appellant no. 3 & 5

Patna High Court CR. APP (SJ) No.2668 of 2026(2) dt.13-08-2026

4. These appellants challenge the order dated 30.06.2026 passed by learned Special Judge, SC/ST Act, Bettiah in connection with Shikarpur P.S. Case No. 530/2026, registered under Sections 126(2), 115(2), 109(2), 75, 303(2), 351(2), 352 of the B.N.S. and Section 3(i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (for short “SC/ST Act”), whereby the prayer for anticipatory bail of appellants and other co-accused has been rejected.

5. As per prosecution case, on 22.05.2026, all the accused persons named in the F.I.R. including appellants, armed with lathi, danda, iron rod and fatta, came at the door of informant and started abusing him with caste name and on protest by informant, all the accused persons assaulted him and other family members. Co-accused Raju Devi snatched gold Mangalsutra from the neck of informant’s wife and Sarda Devi.

6. Learned counsel for the appellants submits that both parties are co-villagers and on account of minor dispute, Maarpeet took place in which both sides sustained injures. Case and counter case. It is not the case of the informant that at the time of alleged occurrence, any public was present and as such, no case under the SC/ST Act is made out.

7. Learned Spl. Public Prosecutor and learned counsel Patna High Court CR. APP (SJ) No.2668 of 2026(2) dt.13-08-2026

for the respondent no. 2 vehemently opposes the appeal.

8. However, considering the aforesaid facts and circumstances, the impugned order is, hereby, set aside in respect of appellant nos. 3 & 5 and this criminal appeal is, accordingly, disposed of.

9. Let the appellant nos. 3 & 5, as named above, in the event of arrest or surrender within a period of eight weeks from today, be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, SC/ST Act, Bettiah (West Champaran) in connection with Shikarpur P.S. Case No. 530 of 2026.
