2. The petitioner is apprehending his arrest in connection with Agamkuan P.S. Case No. 73 of 2021 for the offence under sections 419 and 420 of the Indian Penal Code lodged on 25.01.2021 by the informant, Rahul Kumar Chaurasia.

3. As per the prosecution story, the informant alleged that while checking the admit card, it was found that an impostor was entering the examination hall. Sonu Kumar, who was entering the examination hall in the name of Shashikant Kumar, was taken into custody, and it transpired that the person was not Sonu Kumar but the present petitioner, Manish Kumar. This led to the FIR.

4. Learned counsel for the petitioner submits that, at Patna High Court CR. MISC. No.29365 of 2026(4) dt.07-08-2026

that time, he got the benefit of Section 41(A) of the Cr.P.C. as he cooperated in the investigation but now charge-sheet has been submitted and as such, the anticipatory bail application. The submission is that in the said NTPC examination, he was standing outside and had no role to play in entering in the name of the candidate, Shashikant Kumar but was picked up by the Police.

5. Learned APP, Mr. Bharat Bhushan opposes the prayer submitting that he was entering with the admit card of Shashikant Kumar.

6. Taking into account the submissions of the parties as also that earlier he got the benefit of Section 41(A) of the Cr.P.C., in that background, this Court is inclined to extend him the privilege of anticipatory bail with conditions.

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Patna City in connection with Agamkuan P.S.
