ORAL ORDER

07-08-2026

1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code as well as Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. Learned A.P.P. for the State, at the outset, submits that earlier petitioner had moved this Court seeking anticipatory bail by filing Cr. Misc. No. 13730 of 2026 and the petitioner was granted the privilege of provisional anticipatory bail by an order dated 12.03.2026 with a direction to the learned trial court to verify the antecedent of the petitioner. It appears that petitioner in Cr. Misc. No. 13730 of 2026 had pleaded at para 3 that he is a person with clean antecedent when he had Patna High Court CR. MISC. No.54873 of 2026(2) dt.07-08-2026

antecedent of six cases which amply demonstrates that petitioner while seeking anticipatory bail had not approached this Court with clean hands. It is further submitted that if the privilege of regular bail is granted to the petitioner, the petitioner may abscond or try to tamper with the evidence.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner has antecedent of six cases and is in custody since 11.06.2026 and allegation is of recovery of 820.440 litres of liquor from a Bolero Pickup vehicle of which the petitioner is the owner.

5. Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to release the petitioner on bail in connection with S.T. No. 546 of 2022 arising out of Bibhutipur P.S. Case No. 47 of 2024 pending in the Court of learned Exclusive Special Judge, Excise-I, Samastipur/Successor Court.

6. Hence, the prayer for bail is rejected.
