ORAL ORDER
07-08-2026 Heard the parties.
2. The present application has been preferred for the following relief(s):
(a) for issuance of writ in the nature of mandamus directing / commanding the concern respondent to take immediate necessary and lawful action upon the application / representation filed by the petitioners (as contained in Annexure P/3 series).
(b) For further directing the concern respondents to restore their possession of the land in question to the petitioners immediately under the provisions of section 22 of Bihar Bhoodan Yagna Act 1954. Since earlier Bhoodan Parchas were issued to the petitioners with respect to the disputed plot.
(c) The writ petitioners also pray before this Hon'ble Court to hold and adjudicate that the petitioners are Bhoodan Parcha Holder and thus the concern respondents are duty bound to eject the persons who are in lawful possession of lands as per the provision under section 22 of the Bihar Bhoodan Yagna Act 1954.
(d) For other appropriate writ/writs, order /orders, direction / directions as this Hon'ble Court may deem fit and proper in the facts and circumstances of this case.
3. After argument, learned counsel for the petitioner submits that each and every individual/petitioner herein shall be preferring a fresh petition before the respondent no. 6, the District Collector-cum-District Magistrate, Munger for the redressal of the grievance.
4. At the outset, learned counsel for the Bhoodan Yagna Committee submits that stale claim is being put forward by individual persons as in some case, alleged parcha was issued in the year 1964 while in others, it is of the year 1996 and decades later, the present writ petition.
5. This Court has taken note of the submissions put forward by Bhoodan Yagna Committee. The petitioners only want liberty to approach the concerned respondent.
6. In that background, granting liberty and without commenting on the merit of the case, the writ petition is disposed of.
