ORAL ORDER
29-07-2026 Heard the parties.
2. The petitioners are apprehending their arrest in connection with Islampur P.S. Case No. 93 of 2026 for the offence under sections 103(1), 3(5) of the BNS lodged on 10.03.2026 by the informant, Kaushar Khatun.
3. As per the prosecution story, the informant alleged that the girl was married to Md. Rustam and she was tortured for dowry and they also transferred one decimal of land in favour of the deceased. Thereafter, the pressure was made to construct the building. On 10.03.2026, came the news about her death which led to the FIR.
4. Learned counsel for the petitioners submit that at best, the allegation revolves around the husband who firstly wanted a piece of a land and once the land was transferred in the name of the deceased, the pressure was made for construction of building. These petitioners who are mother-in-law and two married sisters-in-law have absolutely no concern with the demand made by the husband, Md. Rustam. However, only because they belong to the family, got implicated. Further submission is that the postmortem report which is part of the petition records her death as asphyxia due to hanging.
5. Learned APP opposes the prayer submitting that though the demand of land/construction may relate to the husband, suspicion has been raised against these petitioners also.
6. Taking into account the submissions of the parties as also that these petitioners are aged, mother-in-law and two married sisters-in-law residing at different places, the demand as reflects in the F.I.R is mainly against Md. Rustam, the husband, one of the petitioner is residing in Uttar Pradesh at her in-law’s house, none have criminal antecedent, in that background, this Court is inclined to extend them the privilege of anticipatory bail with conditions.
7. Let the petitioners be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned A.C.J.M.-I, Hilsa Nalanda in connection with Islampur P.S. Case No. 93 of 2026 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioners who shall provide official document (Aadhaar Card/Voter ID Card/Pan Card/Driving License) to show his/her bona fide;
(ii) the petitioners shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the Trial Court itself;
(iii) the petitioner shall be appearing before the Police Station as and when required for cooperating in the investigation;
(iv) the petitioners shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioners shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds.
