ORAL ORDER
(Per: HONOURABLE MR. JUSTICE SANJAY KUMAR SINGH )
24-07-2026 Instant Criminal Appeal, arising out of judgment and order dated 30.07.2009 passed by Additional Sessions Judge-XI, Patna, in Sessions Trial No.155 of 1994 (G. R. No.2832 of 1992 arising out of Shastrinagar P.S. Case No. 456 of 1992) is listed for hearing.
2. Despite repeated calls, none appears on behalf of the appellant, whereas Mr. Abhimanyu Sharma, learned Additional Public Prosecutor for the State is present.
3. Perusal of record shows that vide communication dated 25.04.2026 of Assistant Registrar, Criminal Appeal Section of this Court, a living status report of accused appellant was called for. In response thereto, Senior Superintendent of Police, Patna, submitted a report dated 18.05.2026 based on the Patna High Court CR. APP (DB) No.787 of 2009(4) dt.24-07-2026
information furnished by S.H.O., Dighwara, Police Station apprising this Court that the sole appellant namely, Bindubhushan Singh has died during pendency of this Criminal Appeal. The Death Certificate issued by the Mukhiya, Gram Panchayat Raj, Sitalpur, Dighwara (Saran), Bihar, is also enclosed along with the said report.
4. In view of the above, the instant Criminal Appeal filed by appellant Bindubhushan Singh stands abated.
