ORAL ORDER

24-07-2026 Heard learned Advocate for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner apprehends his arrest in connection with Pasraha P.S. Case No. 71 of 2023, registered for the offences punishable under Section 379 IPC.

3. Allegedly the motorcycle of the informant was stolen away from a temple by unknown thieves, while he had gone to offer puja.

4. Learned Advocate for the petitioner submitted that the FIR has been instituted against unknown thieves, but subsequently during the patrolling, the petitioner along with one Gaurav Kumar was apprehended in connection with Gopalpur P.S. Case No. 162 of 2023. The petitioner has nothing to do with the motorcycle, which is the subject matter in the present case, Patna High Court CR. MISC. No.24983 of 2026(4) dt.24-07-2026

but later on his name has been implicated in this case, irrespective of the fact, the petitioner was only a pillion rider of the said motorcycle, which had been driven by Gaurav Kumar.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submits that the petitioner was apprhended along the stolen motorcycle which is a subject matter of the present case, besides the petitioner is carrying two criminal antecedent of identical nature.

6. Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the fact that the petitioner was apprehended with the stolen motorcycle, as also carrying two criminal antecedent; this Court is not acceeded to the prayer for anticipatory bail of the petitioner.

7. Accordingly the present application stands rejected.

8. However, if the petitioner surrenders before the jurisdictional Court within a period of four weeks from today, his prayer for regular bail shall be considered without being prejudiced by the order of this Court.
