ORAL ORDER

23-07-2026 Heard learned counsel for the petitioner, learned APP for the State and perused the case diary.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

3. As per allegation in the FIR, informant’s daughter aged about 16 years was abducted on 08.06.2023 by one Md. Ehsan with the intent of marriage and on 12.06.2023, upon receiving information that his daughter was being kept at the accused’s residence, the informant went there and requested her release, but the mother of the petitioner, Fatima Khatun, and brother, Md. by the neck with intent to kill and attacked him with a sharp- edged knife, causing serious injury, after which the informant was rescued by bystanders and hospitalized.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the petitioner’s brother, namely, Md. Ehsan and daughter of the informant were having love affair between them and the informant and his family members approached the house of the petitioner and his mother, namely, Fatima Khatoon and started exerting pressure upon them to immediately solemnize the marriage between Md. Ehsan and the daughter of the informant. Petitioner has got clean antecedent as stated in para-3 of the petition.

5. Learned APP for the State opposes the prayer for anticipatory bail of the petitioner and submits that he abused the informant in the aftermath of which he was hospitalized.

6. On perusal of the first information report, case diary and impugned order dated 02.04.2026, it appears that there is direct and specific allegation of penetrating knife in the victim’s body against the petitioner. The injury report of the victim, which is the informant, namely, Md. Irshad, the doctor has found sharp incised cut found over the body of the victim Patna High Court CR. MISC. and the repetition of knife blow found over vital organ of the victim and several witnesses have also supported the case of the prosecution, so I am not inclined to grant anticipatory bail to the petitioner.
