ORAL ORDER

22-07-2026 Heard learned Advocate for the petitioners and learned Additional Public Prosecutor for the State.

2. The petitioners, eight in number, apprehend their arrest in connection with Halsi P.S. Case No. 142 of 2025, registered for the offenses punishable under Sections 126(2), 115(2), 109(1), 303(2), 352, 3(5) and 351(2) of the B.N.S.

3. Allegedly on the given date and time of occurrence, Patna High Court CR. MISC. No.48389 of 2026(2) dt.22-07-2026

while the informant was engaged in feeding her cattle, in the meanwhile, sixteen named accused persons, including the petitioners, variously armed with lathi, danda and khanti came there and started abusing and assaulting the informant. It is specifically alleged that petitioner no. 5 assaulted the informant over his head by means of khanti, due to which she sustained serious injuries. There is further allegation against the petitioner no. 3 of snatching the valuables, besides omnibus allegation against others.

4. Learned Advocate for the petitioners submitted that there is a counter version of the present case, being Halsi P.S. Case no. 143 of 2025 instituted against the informant and her mother. The parties are none else but the gotiyas. However, on account of some trifle, they entered into a free fight, resulting into the institution of the case and counter case. So far the injury, which is allegedly sustained to the informant and attributed against petitioner no. 5 is concerned, the same is found to be simple in nature. To support the aforesaid contention, the injury report has been placed on record as Annexure 2 to the bail application. The petitioners are men of fair antecedent and they undertake that they will fully cooperate in the proceeding of the Court.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioners have actively participated in the crime and brutally assaulted the informant and snatched the valuables.

6. Regard being had to the submissions made on behalf of the parties and considering the genesis of the occurrence, coupled with the factum of case and counter case, besides the simple nature of the injury as well as the fair antecedent of the petitioner, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Halsi P.S. Case No. 142 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
