ORAL ORDER
21-07-2026 Heard the parties.
2. The present petition has been preferred for the following relief(s): “I. for direction the respondents to restore total 1acre 01 decimal land in petitioner's jamabandi No 252 with regard to khata No 23,24, khesra No 129,133,134,363 & 99, mauza Lakshmipur, Thana No 449, Circle- Silao for which malgujari has been deposited by the petitioner since 2005-06 till 2020-21

but suddenly, khata number, khesra number and rakba of aforesaid land has been deleted from jamabandi No 252 and in jamabandi No 252 in place of khata No 23,24 and khesra No 129,133,134,363,99 has been mentioned as Zero and rakba in place of 01 acre 01 decimal Zero Acre 99.5 decimal has been has been mentioned without given any notice or opportunity for hearing to the petitioner over which land the ancestral and the petitioner has peaceful possession for more than 100 years without any objection.
II. for direction the concerned respondents to take appropriate action against the respondent No 6 who has knowingly and willfully having arbitrary manner illegally deleted said land from jamabandi No 252 and added this land in jamabandi of the private respondent and other persons illegally in spite of that case of the private respondent for namantran and creating jamabandi has been rejected by then Circle officer Silao and DCLR Rajgir and matter is pending before the Patna High Court CWJC No.8730 of 2025(3) dt.21-07-2026
court of Divisional Commissioner, Patna in Land dispute Appeal No 131/2022 & 132/2022.
III. for passing any such order and direction in the interest of justice and ends of justice in favor of the petitioner.”
3. After some argument, learned counsel for the petitioner submits that he has already filed an appeal against the order passed by the Additional Collector, Nalanda before the Collector, Nalanda at Biharsharif vide Jamabandi Appeal Case No. 54 of 2026-2027.
4. In that background, when an appeal has already been filed, parties including the respondent no. 7 will have all the opportunity to put forward their respective views and expecting the respondent to take Jamabandi Appeal Case no. 54 of 2026-2027 to its logical conclusion, at an earliest, the writ petition stands disposed of.
