ORAL ORDER

15-07-2026

Heard the learned Advocate for the petitioner and the learned Additional Public Prosecutor for the State. The O.P. No. 02 is represented through Bishwanath Mahto, learned Advocate.

2. The petitioner apprehends his arrest in connection with Pipra P.S. Case No. 29 of 2026, registered for the offences punishable under Sections 316(5), 318(4) & 338 of the BNS.

3. Based upon the written report filed by the Secretary of the school alleging therein that despite the fact that petitioner being a junior teacher of the school in-conclusion with Block Education Officer have operated the account of the school and by making a fraudulent signature withdrew rupees ninety thousands. It is also alleged that the petitioner had never been in-charge of the school nor the senior teacher, Mr. Shankar Singh, who was the in-charge of the school has ever been handed over the charge of the account, and as such, serious embezzlement of Government exchequer has been caused by the petitioner.

4. Learned Advocate for the petitioner submitted that the present case is on offshoot of mala fide at the hands of Shankar Singh against whom the petitioner had made a complaint before the higher authorities and in response to the aforesaid complaint, the District Program Officer (establishment), East Champaran, Motihari, directed the Member Secretary-cum-Block Education Officer, Chakia, East Champaran to take disciplinary action against him. The FIR also depicts that the said Shankar Prasad has been shown to the witness to the alleged occurrence. Moreover, the petitioner completely denied that he has withdrawn the money by making fraudulent signature of the Secretary of the school. Nonetheless, as the police was chasing the petitioner, he has already deposited the alleged defalcated amount on 19.01.2026 in the account of the School. It is further submitted that with respect to the said occurrence, till date, no disciplinary proceeding has even been initiated against the petitioner.

5. On the other hand, learned Advocate for the State opposed the pre-arrest bail application and submits that the petitioner bears one criminal antecedent and there is a serious allegation of withdrawing alleged amount from the school account by making fraudulent signature of the Secretary of the school. The deposit of the defalcated amount clearly depicts his admission to the guilt.

6. Having considered the submission advanced by the respective parties and taking note of the fact that with respect to the genuineness of signature, the investigation is still going on, besides the fact that the petitioner has already deposited the defalcated amount in the account of the school and he is ready to participate in the investigation as well as disciplinary proceeding, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.25,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sadar, East Champaran, Motihari in connection with Pipra P.S. Case No. 29 of 2026, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
