1. Heard learned counsel for the appellants and learned Spl. P.P. for the State, Sri Binay Krishna.
2. Learned counsel for the appellants submits that during the course of investigation, appellants have given notice under Section 35(3) BNSS, as such the appellants presently do not have any apprehension of arrest, thus seeks permission to withdraw the appeal with liberty to file afresh, if need arises.
3. Permission is accorded.
4. Accordingly, the appeal is dismissed as withdrawn with the aforesaid liberty.
