ORAL ORDER

14-07-2026 Heard learned Advocates appearing for the respective parties.

2. At the outset, Mr. Bipin Kumar, learned Advocate for the petitioners, sought permission to withdraw the application on behalf of petitioner nos. 1, 2, and 4.

3. Permission is accorded.

4. Accordingly, the application on behalf of petitioner nos. 1, 2, and 4 stands dismissed as withdrawn.

5. The petitioners no.3, 5 and 6 are apprehending their arrest in connection with Mehus P.S. Case No.4 of 2026 registered for the offences punishable under Sections 191(3), 190, 126(2), 127(2), 115(2), 109(1), 304(2), 324(2), 351(2), 352 of the BNS, 2023 and Sections 25(1-b)a, 26 and 35 of the Arms Act.

6. It is alleged that on the given date and time of occurrence, while the informant along with his brother was proceeding to attend the birthday celebration of his nephew, certain persons started chasing them on motorcycles. Thereafter, they surrounded and assaulted the informant with the butt of pistol, lathi, danda, iron rod and khanti, causing him serious injuries. It is further alleged that the accused persons also snatched his valuables. When the informant's brother, Sachin Kumar, came to his rescue, the accused persons caught hold of him and brutally assaulted him as well, causing him grievous injuries. Subsequently, the informant's sister and her in-laws identified the accused persons, including the present petitioners.

7. Learned Advocate for the petitioners submitted that the informant himself is involved in cases of robbery and on the date of the alleged occurrence, villagers, suspecting his involvement in criminal activities, gathered and assaulted the informant, his brother and his cousin. It is further submitted that there is no specific allegation attributing any overt act to the present petitioners. Learned counsel also contended that there is an unexplained delay of nearly two days in lodging the First Information Report. It is further argued that, solely on account of the petitioners' criminal antecedents, they have been falsely implicated in the present case without any specific allegation that the injuries sustained to the victims were caused by the petitioners.

8. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that petitioner no. 3 has two criminal antecedents, whereas petitioner nos. 5 and 6 have one criminal antecedent each, and as such they are habitual offenders. It is further submitted that one of the victims has sustained grievous injuries.

9. Having considered the submissions advanced on behalf of the respective parties, and taking note of the fact that none of the injuries sustained by the victims has been specifically attributed to petitioner nos. 3, 5, and 6, coupled with the genesis of the occurrence and the delay in lodging of the FIR, let the above-named petitioner nos. 3, 5, and 6, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Sheikhpura in connection with Mehus P.S. Case No.4 of 2026, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioners.
