ORAL ORDER

23-06-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 331(4), 126(2), 308(2), 308(3), 351(2), 351(3), 61(2) and 3(5) of BNS.

3. The case of the prosecution is that one Bilash Sharma went to the house of the informant and stated that the petitioner has demanded Rs. 10 lacs as rangdari. The informant and her husband were also threatened and the audio clip of threat extended by this petitioner was played before the informant. Further demand was made by the co-accused of an amount of Rs. 2,00,000/- and the informant was threatened of dire consequences.

4. Learned counsel for the petitioner submits that the Patna High Court CR. MISC. No.40244 of 2026(2) dt.23-06-2026

petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the FIR, it is clear that petitioner himself has never demanded any rangdari from the informant. It is alleged that one co-accused Bilash has gone to the house of the informant and on the basis of the recording of this petitioner, it is stated that this petitioner has demanded Rs. 10 lacs as rangdari. Learned counsel has submitted that no rangdari has been paid. It is only a creation of story only for getting Arms License from the District Administration. It has further been submitted that according to the FIR, the petitioner is a notorious person of the area but the petitioner is having no criminal antecedent. There is no direct involvement of this petitioner in this case rather he has been introduced in this case by co-accused Bilash Sharma who has already been granted bail by learned co-ordinate Bench of this Court vide Cr. Misc. No. 88989 of 2024. The case of this petitioner stands on better footing. Moreover, he is languishing in judicial custody since 14.04.2026.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is Patna High Court CR. MISC. No.40244 of 2026(2) dt.23-06-2026

inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Beldour P.S. Case No. 327 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-1st Class, Khagaria.
