(Oral)

1. The present petition is the first petition filed by the petitioner under Section 483 of the BNSS, 2023 (corresponding to Section 439 Cr.P.C.), seeking grant of regular bail to the petitioner in the case arising out of FIR No.143 dated 21.09.2025, registered under Sections 21(c), 27-A and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Sections 10, 11 and 12 of the Aircraft Act, 1934, Section 317(2) of the Bharatiya Nyaya Sanhita, 2023 (corresponding to Section 411 IPC), at Police Station Dera Baba Nanak, District Gurdaspur.

2. There is no representation on behalf of the petitioner. Perusal of the record shows that the copy of Annexure P-3 appended with the petition pertains to some other FIR/criminal case. Further, the allegations against the petitioner in the present case relate to recovery of heroin, whereas the challan appended with the petition pertains to an offence punishable under Section 108 of the Bharatiya Nyaya Sanhita, 2023. Thus, the documents relied upon by the petitioner do not pertain to the present case.

3. In the absence of any representation on behalf of the petitioner and in view of the aforesaid discrepancy in the documents appended with the petition, no ground for grant of regular bail is made out.

4. Dismissed. (VIRINDER AGGARWAL) JUDGE 11.09.2026 kv Whether speaking/reasoned : Yes/No Whether reportable : Yes/No KUMUD VERMA 2026.09.11 17:00 I attest to the accuracy and integrity of this document Chandigarh
