, J. (Oral) The prayer in the present petition preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) is for the grant of anticipatory bail in case FIR No.10, dated 20.01.2026, registered at Police Station Sadar Nakodar, District Jalandhar, under Sections 18C, 27A of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short the “NDPS Act”) (Section 29 NDPS Act added subsequently).

On 20.01.2026, one Dharminder Singh and Charanjit Kaur were apprehended. 7 k.g. of opium was allegedly recovered from Charanjit Kaur and 1 k.g. from Dharminder Singh. Upon interrogation, they suffered a disclosure statement naming 5 people, including the petitioner, stating that out of 10 k.g. of opium that they had purchased, 1 k.g. had been supplied to the present petitioner. Learned counsel for the petitioner inter alia submits that the petitioner has been falsely implicated. He submits that the Special Court, Jalandhar erroneously dismissed the anticipatory bail application of the petitioner by stating that there was a money trail between the main accused and the petitioner, whereas actually the same was between the main accused and one Balraj @ Ballu, resident of Jalandhar, who had also been named in the disclosure statement. He submits that there is no money transaction of the main accused with the petitioner and apart from the disclosure statement, there is no other evidence to link the petitioner with the sale of 1 k.g. of opium by the main accused to him. He further submits that two other co-accused, who also had allegedly purchased 1 k.g. each of opium from the main accused, were arrested and granted regular bail. He submits that the petitioner has clean antecedents and is willing to join investigation and abide by any condition imposed by the Court. Notice of motion. Mr. Ravinder Singh, DAG, Punjab accepts notice on behalf of the respondent-State. List on 10.09.2026. In the meantime, the petitioner is directed to join investigation. In the event of arrest, he shall be NISHA
released on interim bail to the satisfaction of the Arresting/Investigating Officer, subject to compliance of the provisions of Section 482(2) BNSS.”
3. Learned counsel for the petitioner submits that in compliance with the aforesaid order, the petitioner has duly joined the investigation.

Sadar Nakodar, District Jalandhar Rural, who is present in Court, submits that in compliance with the order dated 14.08.2026, the petitioner has duly joined the investigation and his custodial interrogation is not required.
