1. Petitioners seek quashing of FIR No.11 dated 07.02.2024 under Sections 323, 458, 427, 148, 149 IPC, Police Station Dirba, District Sangrur and all consequential proceedings arising therefrom, on the basis of compromise dated 15.09.2025. Sections 148 and 149 IPC were deleted and Sections 459, 325 and 34 IPC were added in the FIR during investigation.

2. On 21.11.2025, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements with regard to compromise dated 15.09.2025.

3. In compliance of the aforesaid order, parties appeared before learned Additional Sessions Judge, Sangrur on 15.12.2025. Statement of Investigating Officer ASI Rajwinder Singh was recorded on 14.01.2026. Learned Additional Sessions Judge, Sangrur has submitted his report recording satisfaction that all the parties have entered into a valid compromise without any influence or coercion. Point-wise report as under has been submitted:

“It is submitted that as per statement of complainant/injured Jagsir, FIR was registered and report under Section 173 Cr.P.C. was presented against petitioners Gursewak Singh, Amrinder Singh and Sukhchain Singh who have been arrayed as an accused in the FIR in question and except them, there is no other accused in the present FIR.

It is submitted that as per statement of the complainant, there is no other injured person in the present case except him.

It is also submitted that as per statement of complainant and accused, the accused and complainant/injured are party to compromise and signed the same.

It is further urged that affected person i.e. complainant/injured Jagsir Singh and accused Gursewak Singh, Amrinder Singh and Sukhchain Singh have been arrayed as party in the quashing petition before the Hon’ble High Court of Punjab and Haryana.

It is further urged that the petition is found to be filed by all the accused persons in the case and all have approached the Court seeking of the proceedings on the basis of compromise and statement of complainant/victim has been recorded in this regard.

It is further urged that as per statement of ASI Rajwinder Singh, there is one complainant/injured and three accused namely Gursewak Singh, Amrinder Singh and Sukhchain Singh in the present FIR. The challan was presented against accused. However accused Gursewak Singh, Amrinder Singh and Sukhchain Singh are not declared as proclaimed offender till today.

The case is at the stage of prosecution evidence.

The compromise as per statements of Jagsir Singh complainant/injured, and accused/petitioners Gursewak Singh, Amrinder Singh and Sukhchain Singh has been arrived at voluntarily and without any coercion or undue influence between them.”

4. Learned State counsel has not raised any dispute regarding the factum of compromise. Status report by way of affidavit of Ms. Rupinder Kaur, PPS, Deputy Superintendent of Police, Sub Division, Dirba on behalf of respondent No.l-State has been filed, which is taken on record. As per status report, petitioners were the only accused in the FIR and no involvement of any other person was found in the investigation, whereupon, offences under Sections 148, 149 were deleted and Sections 459, 325 and 34 IPC were added. Since the matter has been amicably resolved, continuation of the criminal proceedings would be an exercise in futility.

5. Following principles of law laid down by the Full Bench Judgment of this Court in “Kulwinder Singh and others Vs. State of Punjab and another” 2007(3) RCR (Criminal) 1052 and Hon’ble Supreme Court in “Gian Singh Versus State of Punjab and others” (2012) 10 SCC 303, the petition is allowed.

6. FIR No.11 dated 07.02.2024 under Sections 323, 458, 427, 459, 325 and 34 IPC, Police Station Dirba, District Sangrur and all consequential proceedings arising therefrom, are quashed qua the petitioners, on the basis of compromise dated 15.09.2025.

7. Pending applications, if any, stand disposed of.
