The prayer in the present petition preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) is for the grant of anticipatory bail in case FIR No.90 dated 06.08.2025, registered at Police Station Bareta, District Mansa, under Sections 109, 333, 118(1), 191(3), 190, 118(2) of the BNS.

Then, I have borrowed a tractor from Major Singh of our village, attached a water tanker behind it and brought a tanker filled with water from the police canal distributary (Police Sua) Situated on the Panja Peeran Wale road. I have filled the drums kept inside the new under construction house with that water and then I was assembling the old bricks lying inside the house that at about 8:00 AM in the morning, I was working alone inside my house. In the meantime, 8/10 persons armed with deadly weapons entered in the house. Out of them, Deep Singh resident of Daska was armed with a sword, Bazi Chandpura was armed with a gandasa, Gurwinder Singh alias Maula son of Mithu Singh was armed with a gandasa, Ravi Sharma son of Sabil Das was armed with a pistol; Bittu Saini was armed with a sword, Jaipal Saini was armed with a gandasa, Sonu Pandit son of Joga Pandit was armed with a sword and Leela Chakkiwala was armed with a sword, all residents of Kulrian along with two unidentified persons armed with deadly weapons and riding on motorcycles and were

3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that co- accused Baaru Singh and Bittu Saini @ Bitu Singh have been granted regular bail by a Coordinate Bench. Reference has been made to the orders Annexures P.3 to P.4. He further submits that the injuries alleged to have been given by the petitioner were on non-vital parts. He submits that the antecedents of the petitioner are clean. It is further submitted that the petitioner is willing to join investigation and abide by any condition imposed by the Court.
4. Per contra, learned State counsel has opposed the prayer for the grant of pre-arrest bail stating that the allegations are very serious. He submits that under the circumstances, the
Page 4 of 5
petitioner does not deserve to be extended the concession of anticipatory bail.
5. I have considered the submissions made by learned counsel for the parties.
6. The petitioner is said to have been armed with a billhook (gandasi) with which he is alleged to have inflicted injuries on the arm and leg of the complainant. The said injuries were found to be grievous in nature. The grant of regular bail to the co-accused, would not come to the aid of the petitioner since the parameters for grant of anticipatory bail and regular bail are entirely different. Not only this, the anticipatory bail petition filed by co-accused Jagdeep Singh @ Deep was dismissed by the same Bench vide order dated 13.07.2026 passed in CRM-36022- 2026, which had granted regular bail to the other co-accused.
7. Keeping in view the gravity of the allegations and the nature of injuries suffered by the complainant, this Court does not find any reason to extend the concession of anticipatory bail to the petitioner.
8. That being so, the present petition is found to be devoid of merit and is accordingly dismissed.
