1. Petitioners seek regular bail in FIR No.73 dated 09.06.2025 under Sections 333, 190, 191(3), 117(2) of Bharatiya Nyaya Sanhita (B.N.S.), 2023, Police Station City Jalalabad, District Fazilka. Section 238 BNS has been added in the FIR during investigation. This is the first petition for regular bail.

2. As per allegations, 06.05.2025, at about 10:00-11:00 P.M., Harjinder Singh, armed with baseball bat accompanied by Sangam, armed with gandasa, scaled the wall of complainant’s house, opened main gate from inside, whereafter, complainant was given beatings. Petitioner No.1-Aniket is alleged to have given beatings with baseball bat, which hit her right wrist whereas Sangam allegedly gave gandasa blow, which hit the thumb of her left hand. Karan, who was standing next to them waved kirpan.

3. Learned counsel for the petitioners submits that petitioners were in custody for the last more than three months. Investigation was complete and challan had been presented in the Court. The injuries attributed to both petitioners were simple in nature. Trial would take long to conclude. HARPREET SINGH CHAUHAN 2026.09.03 19:38 I agree to specified portions of this document

Therefore, petitioners, who were 20/23 years old, deserved to be enlarged on regular bail.

4. Notice of motion.

5. Mr. Sukhbeer Singh, DAG Punjab accepts notice on behalf of respondent-State. He files custody certificate dated 01.09.2026 and status report by way of affidavit of Mr. Lavdeep Singh Gill, PPS, Deputy Superintendent of Police (HQ), Fazilka, which are taken on record. He opposes the prayer for regular bail on the ground of serious and specific nature of allegations against the petitioners.

6. Co-accused, namely, Rajinder Singh alias Harjinder Singh has been allowed regular bail by learned Additional Sessions Judge, Fazilka. Allegations against the petitioners are not on worse footing. They are in custody with effect from 25.05.2026. Investigation of the case is complete. Petitioners are both residents of same village, namely, Village Middha, Tehsil Jalalabad West, District Fazilka and have a fixed abode. There is no reason to believe that they would evade the process of law or tamper with evidence. Culmination of trial is likely to take long. Considering all relevant facts and circumstances of the case, but without a comment on merits, the petition is allowed. Petitioners are ordered to be released on regular bail, subject to their furnishing adequate bail and surety bonds to the satisfaction of Trial Court/Duty Magistrate.

7. Pending miscellaneous applications, if any, also stand disposed of.
