1. The Criminal Writ Petition under Article 226/227 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita (B.N.S.S.), 2023 seeks directions to respondents No.2 to 4 to ensure adequate protection of life and liberty of petitioner from private respondents.

2. Learned counsel for the petitioner submits that petitioner was married to Manjit Singh s/o Shamsher Singh, who was addicted to intoxicants. Manjit Singh was owner of ancestral agricultural land, in which petitioner and their children had valuable legal and civil rights. Due to addiction, petitioner filed a civil suit against him, during pendency of which, he sold his property to respondent No.5. Petitioner filed another civil suit challenging the sale deed in favour of respondent No.5. During pendency of that litigation, respondents No.5 and 6 were extending threats to the petitioner, demanding her to vacate the land and warning her of serious consequences. Petitioner feared for her life and liberty. In this context, representation was moved but no action was taken.

3. Notice of motion to official respondents only. HARPREET SINGH CHAUHAN 2026.09.03 19:38 I agree to specified portions of this document

4. Mr. Kunwarbir Singh, AAG Punjab accepts notice on behalf of respondent-State and submits that representation (Annexure P-3) was received by the office of Senior Superintendent of Police, Sangrur but was filed when petitioner made statement that she would seek her remedy in the Civil Court. Subsequently, another representation (Annexure P-4) was received on similar allegations and that was pending.

5. The dispute between petitioner and private respondents apparently pertains to possession of agricultural land, which petitioner’s husband had sold to respondent No.5. There is a civil suit (Annexure P-2) filed by petitioner in that regard. The dispute of possession over the land is best left to the competent Civil Court to determine. Since the dispute is civil in nature, no intervention by this Court is warranted.

6. The petition stands disposed of.

7. Pending miscellaneous applications, if any, also stand disposed of. (SHALINI SINGH NAGPAL)
