(214) IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH

CRM-M-26100-2026 Date of Decision: 03.09.2026 JASHANPREET SINGH ... Petitioner Versus STATE OF PUNJAB ...Respondent CORAM: HON'BLE MR. JUSTICE JASJIT SINGH BEDI Present: Mr. Mohd. Yousaf, Advocate with Ms. Arzoo Modi, Advocate for the petitioner. Mr. Roshandeep Singh, Asstt. A.G., Punjab. **** JASJIT SINGH BEDI, J. The prayer in the present petition under Section 483 of BNSS, 2023 is for the grant of regular bail in case bearing FIR No.95 dated 08.07.2025 registered under Sections 105, 3(5) BNS and Sections 21, 22, 27 of NDPS Act at Police Station Sadar Ahmedgarh, District Malerkotla.

2. The learned counsel for the petitioner contends that the allegations levelled against the petitioner are baseless. One Manveer Singh alias Manvir Singh has been granted the concession of bail by this Court vide order dated 29.04.2026 (Annexure P-2). As the petitioner is in custody since 09.07.2025 but only 04 of the 18 prosecution witnesses have been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail. 3. On the other hand, the learned State counsel contends that the allegations against the petitioner and the co-accused are that they were pressurizing the deceased to consume drugs and were also procuring the same for him. Therefore, he is not entitled to the concession of bail. He, however, concedes that the petitioner is in custody since 09.07.2026 but only 04 of the 18 of the prosecution witnesses have been examined so far and that a similarly situated co-accused namely, Manveer Singh alias Manvir Singh has been granted the concession of bail by a Coordinate Bench of this Court vide order dated 29.04.2026 (Annexure P-2).

4. I have heard the learned counsel for the parties.

5. The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is a first-time offender, in custody since 09.07.2026 but only 04 of the 18 prosecution witnesses have been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation the further incarceration of the petitioner is not required moreso when a co-accused namely, Manveer Singh alias Manvir Singh has been granted the concession of bail by a Coordinate Bench of this Court vide order dated 29.04.2026 (Annexure P-2)

6. Thus without commenting on the merits of the case, the present petition is allowed and the petitioner-Jashanpreet Singh S/o Satnam Singh is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. JITESH LAL
