CORAM : HON’BLE MR. JUSTICE VIKRAM AGGARWAL

Present: None for the petitioner.

Ms. Jasmine Gill, AAG, Haryana.

*** VIKRAM AGGARWAL, J (ORAL)

The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’) for issuance of a roving writ in the nature of habeas corpus to search for the detenue namely X (wife of the petitioner) from the wrongful and illegal confinement of respondents No.4 to

8.

2. On 24.06.2026, the following order was passed by a coordinate Bench:- “Coordinate Bench of this Court, vide order dated 16.06.2026, had directed the Registry of this Court, to appoint a Warrant Officer, forthwith, who shall search for the detenue at the address of respondents No.4 to 8, and thereupon, file a status report in this regard. As per report of the Registry, a Warrant Officer, in the instant matter, could not be appointed as the petitioner has not deposited the fee and expenses of Warrant Officer. Learned counsel for the petitioner submits that the petitioner is unable to bear the fee of a Warrant Officer. However, he submits that the detenue is illegally confined by the private respondents No.4 to 8. At this stage, without evaluating the veracity of the allegations as alleged in the instant petition, a direction is passed upon the respondent No.3, to forthwith search the alleged detenue, i.e. Anjali, and thereupon, produce her before the Illaqa Magistrate/Chief Judicial Magistrate, concerned, who after recording her statement, shall take an apt action in accordance with law. CRWP-7199-2026

List on 16.07.2026. The SHO concerned is directed to file a status report in this regard, on or before the next date of hearing.”

3. As per the status report filed in compliance with the said order, the detenue X was produced before the Area Magistrate on 04.07.2026 wherein, her statement was recorded in which, she stated that she had solemnized marriage with the petitioner and that since he was a resident of another State, her family members were not permitting her to go with him. She stated that she wanted to live with the petitioner. Thereafter, the statement of the petitioner was also recorded wherein, he stated that he had met his wife and that he was satisfied that she was not held hostage. The custody of the wife was handed over to him and he had taken her back to the matrimonial home.

4. That being so, no further orders are required to be passed by this Court.

5. The petition is accordingly disposed of.

Pending application(s), if any, also stands disposed of.
