1. Petitioner seeks quashing of order dated 10.08.2026 of learned Additional Sessions Judge, Amritsar, issuing proclamation against him in case arising out of FIR No.55 dated 10.07.2024 under Section 125 of Bharatiya Nyaya Sanhita (B.N.S.), 2023, Police Station Mehta, District Amritsar. Sections 109, 111, 317, 308(4), 263, 61(2) BNS, Sections 25, 27, 54 and 59 of the Arms Act, 1959 have been added in the FIR during investigation.

2. Learned counsel for the petitioner submits that petitioner was arraigned as accused in the afore-mentioned FIR. He had regularly been appearing before the Trial Court. Petitioner’s wife was sexually assaulted by another person, regarding which FIR came to be registered. On that account, petitioner failed to put in appearance before the Trial Court and non-bailable warrants were issued against him. Later, the Court initiated proceedings under Section 84 BNSS. He submits that the case was now fixed for 09.09.2026, awaiting presence of the petitioner after publication of proclamation. Learned counsel states that petitioner never intended to avoid proceedings of the Court and bonafidely intended to face trial.

3. Notice of motion. HARPREET SINGH CHAUHAN 2026.09.03 19:38 I agree to specified portions of this document

4. Mr. Kunwarbir Singh, AAG Punjab accepts notice on behalf of respondent-State. He supports the order passed by learned Trial Court and submits that petitioner failed to disclose the particulars of FIR regarding the mishappening with his wife.

5. Orders passed by learned Trial Court perused. Petitioner-Navraj Singh, who was on bail, failed to put in appearance on 27.03.2026, whereupon the case was adjourned to 04.05.2026. When petitioner still did not put in appearance, he was ordered to be summoned through non-bailable warrants for 02.07.2026 and 23.07.2026. When the non-bailable warrants could not be executed, Court initiated proceedings under Section 82 Cr.P.C. It does not appear from the record that bail of the petitioner has been cancelled or his bonds have been forfeited. Petitioner has not yet been declared a proclaimed person. In these circumstances, without a comment on merits of the impugned order, since petitioner bonafidely intends to join proceedings, he is directed to surrender before learned Trial Court before 09.09.2026. In case he does so, learned Trial Court shall not insist on his furnishing fresh bail and surety bonds. Till then, the proclamation proceedings be kept in abeyance.

6. The petition stands disposed of, on the above terms.

7. Pending miscellaneous applications, if any, also stand disposed of. (SHALINI SINGH NAGPAL)
