fake official stamps and used the documents for illegally obtaining no objection certificate in respect of the vehicles, whereafter, he sold the truck and car.
3. Learned counsel for the petitioner prays for grant of regular bail on the ground that petitioner was in custody w.e.f 11.03.2026. Investigation of the case was complete. He argued that mere default in repayment of loan did not ipso facto constitute cheating or forgery. No forged seal, machine, forged letterhead, stamp or incriminating material was recovered from conscious possession of petitioner connecting him with the offence nor there was any FSL report to establish that false signatures or seals were made by the petitioner. The case was based on documentary evidence. Trial would take long, therefore, petitioner deserved the concession of regular bail.
4. Learned State counsel opposed the prayer for regular bail submitting that petitioner committed his systematic financial fraud upon ICICI bank by availing multiple loans which he failed to pay, illegally removed hypothecation of the ICICI bank from the vehicles, forged NOCs and sold the vehicles to third party by forging and manipulating his identity particulars. Thus, petitioner was not entitled to concession of regular bail.
5. Case is triable by Court of Magistrate. Petitioner is in custody for almost six months. Investigation of the case is complete. Though, petitioner is involved in one other case, that alone cannot be a ground to refuse bail. Truth of the allegations against the petitioner would be determined only on conclusion of trial and his guilt cannot be pre-judged to detain him in custody against the fundamental postulate of criminal jurisprudence of presumption of innocence. The often invoked phrase ‘Bail is the rule and jail is the exception’ is not merely an empty statutory slogan REEMA SAINI

flowing from the Cr.P.C. It is a constitutional principle flowing from Articles 21 and 22 of the Constitution and the presumption of innocent which is the cornerstone of any civilised society governed by the rule of law. (Vide Syed Iftikhar Andrabi Vs. National Investigation agency 2026 SCC online SC 881).
7. In the facts and circumstances of the case, but without commenting on merits, petitioner is ordered to be released on regular bail subject to his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate. All the pending miscellaneous applications, if any, stand disposed of.
