::1:: IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH (225-a) CRM-M-42149-2026 (O & M)

Date of decision:02.09.2026 Balkaran Singh …... Petitioner V/s State of Punjab ...Respondent

CORAM:

HON’BLE MR. JUSTICE JASJIT SINGH BEDI Present: Mr. Naveen Bawa, Advocate, for the petitioner. Mr. M.S. Toor, AAG, Punjab. ***** JASJIT SINGH BEDI,

J. (Oral)

The prayer in this petition under Section 483 BNSS, 2023 (Section 439 Cr.P.C.) is for the grant of the regular bail to the petitioner in DDR No.25 dated 08.05.2020 under Sections 307, 336, 323, 148, 149, 120-B IPC and Sections 25, 27, 54 of the Arms Act (now Sections 109, 125, 115(2), 191(3), 190, 61 of BNS) in FIR No.43 dated 01.05.2020 under Sections 302, 323, 324, 148 and 149 IPC (Sections 103, 115(2), 118(1), 191(3) and 190 of BNS) at Police Station Gharinda, District Amritsar.

2. The learned counsel for the petitioner contends that it is a case of version and cross-version. Jaskaran Singh from the side of the petitioner- Balkaran Singh is the deceased in the cross-case. It would be a moot point during the course of the Trial as to which side is the aggressor side. As the petitioner is in custody since 19.07.2025 but none of the 12 prosecution witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail. 3. The learned counsel for the State, on the other hand, admits the factum that it is a case of version and cross-version, that one Jaskaran Singh from the side of the petitioner-Balkaran Singh is the deceased, that the petitioner has been attributed a gun shot injury on the person of Baljit Singh, that he is in custody since 19.07.2025 and that none of the 12 prosecution witnesses has been examined so far.

4. I have heard the learned counsel for the parties.

5. Admittedly, it is a case of version and cross-version. It would be a moot point during the course of the Trial as to which party is the aggressor party. The petitioner is in custody since 19.07.2025 but none of the 12 prosecution witnesses has been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required.

6. Thus, without commenting upon the merits of the case, the present petition is allowed and the petitioner, namely, Balkaran Singh is ordered to be released on bail to the satisfaction of the Trial Court/Duty Magistrate concerned.

7. The pending application(s), if any, shall stand disposed of accordingly. September 02, 2026
