::1:: IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH (225-2) CRM-M-13779-2026 (O & M)

Date of decision:02.09.2026 Bachittar Singh @ Chatra …... Petitioner V/s State of Punjab and anr. ...Respondent

CORAM:

HON’BLE MR. JUSTICE JASJIT SINGH BEDI Present: Mr. Ruhani Chadha, Advocate, for the petitioner. Mr. M.S. Toor, AAG, Punjab. ***** JASJIT SINGH BEDI,

J. (Oral)

The prayer in this petition under Section 483 BNSS, 2023 (Section 439 Cr.P.C.) is for the grant of the regular bail to the petitioner in FIR No.43 dated 01.05.2020 under Sections 302, 323, 324, 148 and 149 IPC (Sections 103, 115(2), 118(1), 191(3) and 190 of BNS) and Sections 25 & 27 of the Arms Act, 1959 (Sections 326, 307, 336, 120-B IPC [Sections 118(2), 109, 125 and 61(2) BNS] added later on) registered at Police Station Gharinda, District Amritsar.

2. The learned counsel for the petitioner contends that it is a case of version and cross-version. The petitioner-Bachittar Singh @ Chatra has been attributed injuries on the deceased-Jaskaran Singh. However, Baljit Singh from the side of the petitioner has received gun shot injuries at the instance of the present complainant-Balkaran Singh. It would be a moot point during the course of the Trial as to which side is the aggressor side. As the petitioner is in custody since 22.08.2024 but none of the 35 prosecution SUKHPREET KAUR 2026.09.03 09:13 I agree to specified portions of this document

::2:: witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail.

3. The learned counsel for the State does not dispute the fact that it is a case of version and cross-version, that Baljit Singh from the side of the petitioner-Bachittar Singh @ Chatra has received gun shot injuries, that the petitioner is in custody since 22.08.2024 and that none of the 35 prosecution witnesses has been examined so far.

4. I have heard the learned counsel for the parties.

5. Admittedly, it is a case of version and cross-version. It would be a moot point during the course of the Trial as to which party is the aggressor party. The petitioner is in custody since 22.08.2024 but none of the 35 prosecution witnesses has been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required.

6. Thus, without commenting upon the merits of the case, the present petition is allowed and the petitioner, namely, Bachittar Singh @ Chatra is ordered to be released on bail to the satisfaction of the Trial Court/Duty Magistrate concerned.

7. The pending application(s), if any, shall stand disposed of accordingly. September 02, 2026
