Date of Decision: 02.09.2026

Wahid @ Vahid

…Petitioner

V/s State of Haryana

…Respondent

CORAM : HON’BLE MR. JUSTICE VIKRAM AGGARWAL

Present: Mr. Mazlish Khan, Advocate, for the petitioner.

Ms. Vasundhara Dalal Anand, Sr. DAG, Haryana.

*** VIKRAM AGGARWAL, J (ORAL)

This is the second petition preferred under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) praying for the grant of regular bail to the petitioner in case FIR No.746, dated 12.12.2024 registered at Police Station Industrial Sector 29, District Panipat, under Sections 22C and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’), his first petition having been withdrawn on 27.03.2026.

2. On 11.12.2024, on the basis of a secret information, the petitioner (Wahid @ Vahid) was apprehended and 15 injections containing 30 ml NRX Buprenorphine (commercial quantity) were alleged to have been recovered from him.

3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that the petitioner is in custody since the day of his arrest i.e. 12.12.2024; 1 year, 08 months and 18 days have gone by; antecedents of the petitioner are clean; investigation stands completed; final report has been submitted; charges have been framed and out of 28 witnesses, VIKAS CHANDER 2026.09.03 14:57 I attest to the accuracy and integrity of this document

only 1 has been examined. He submits that under the circumstances, trial will take a sufficiently long time, therefore, no useful purpose would be served by keeping the petitioner in custody any longer.

4. Per contra, learned State counsel has opposed the bail application.

5. I have considered the submissions made by learned counsel for the parties.

6. The petitioner is in custody for the last 1 year, 08 months and 18 days, he having been arrested on 12.12.2024. His antecedents are clean. Investigation stands completed. Final report has been submitted and charges have been framed. Out of 28 witnesses, only 1 has been examined as of now, thereby prejudicing his right to a speedy trial. It is, therefore, clear that trial will take a sufficiently long time and in the considered opinion of this Court, no useful purpose would be served by keeping the petitioner in custody any longer.

7. In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate.

8. Pending application(s), if any, shall also stand disposed of.
