CORAM : HON’BLE MR. JUSTICE VIKRAM AGGARWAL

Present: Mr. Vaibhav Gupta, for the petitioner.

*** VIKRAM AGGARWAL, J (ORAL)

The prayer in the present petition preferred under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) is for the grant of regular bail to the petitioner in case FIR No.142, dated 01.07.2025 registered at Police Station Balongi, District SAS Nagar under Sections 310, 109, 118(1), 118(2), 126(2), 304, 351(2), 190, 191(3), 238 of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’).

2. Status report by way of affidavit of Sh. Ishan Singla, Deputy Superintendent of Police, Sub Division Kharar, District SAS Nagar, as also custody certificate filed in Court today are taken on record.

3. On the statement of one Ashok Kumar, the FIR in question was registered, the translated version of which (as given in Annexure P-1) is as under:- “Statement of Ashok Kumar son of Shiv Prasad, resident of village Thakiya, Police Station Jagatpura, District Rae Bareli, UP, resident of near Shiv Mandir, Barhmajra Colony, Blongi, district Mohali, age 27 years, stated that I am a resident of the above address and work as a plumber. On 26.06.2025, I was returning home from work at around 10 PM when I reached near the dirty drain, Barhmajra when 5-6 unknown people surrounded me and one of them showed me a knife and they started snatching my phone and money from me. When I resisted, one of them, who had a knife in his hand, stabbed me two or three times below my chest with the intention of killing me and then stabbed me on both my legs. The other boys were holding me, after which one of the other boys snatched my diary and purse which had Rs. 1200 in it and then started threatening to kill me. On which I took my phone which was about to be snatched and I ran away to save my life and I came near Dara Studio near the liquor shop and called my brother Bipin Singh and he came to the spot who admitted me to CH Phase 6 Mohali for treatment where I had my surgery. Where I am undergoing treatment. I could not give a statement as I was admitted in ICU and action should be taken against 5-6 unknown boys, I wrote a statement which I heard is correct. I came to know that Sunny Kumar S/O Vinod Kumar, Vishal alias Sunny S/o Krishan Pal, Dasant Verma S/o Kali Vasian Barhmajra met 3 unknown people and gambled. Statement maker hindi Ashok Kumar 8858513498)”

4. The said Ashok Kumar was found to have been inflicted with 5 injuries, all of which were incised wounds. 4 out of the same were in the chest and upper abdomen. 3 injuries were found to be dangerous to life.

5. Learned counsel for the petitioner submits that the petitioner is a young boy aged 23 years and is in custody for the last 1 year and 2 months, he having been arrested on 03.07.2025. He further submits that out of 13 witnesses, 4 have been examined and 3 have been given up. He submits that under the circumstances, it will take a sufficiently long time for examination of the remaining witnesses and therefore, no useful purpose would be served by keeping the petitioner in custody any longer.

6. Per contra, learned State counsel has opposed the bail application, stating that the allegations are extremely serious, with the petitioner having inflicted repeated knife blows upon the complainant. He further submits that the complainant has also stepped into the witness box and has supported the case of the prosecution. Learned State counsel submits that if the petitioner is released on bail, he may abscond.

7. I have considered the submissions made by learned counsel for the parties.

8. The allegations against the petitioner are extremely serious. He is alleged to have inflicted repeated knife blows in the chest and abdomen of the complainant. Out of the 5 injuries inflicted, 3 were declared to be dangerous to life. The complainant is lucky to have survived. Still further, the complainant has duly stepped into the witness box and has supported the case of the prosecution. Merely because the petitioner is in custody for the last 1 year and 2 months is no ground to release him on bail. His young age may have been a consideration but keeping in view the seriousness of the allegations and the nature of injuries inflicted upon the complainant, this Court does not find any reason to release the petitioner on bail.

9. That being so, the petition is found to be devoid of merit and is accordingly dismissed.

10. Pending application(s), if any, shall also stand disposed of.

However, nothing stated herein above shall be construed to be an opinion on the merits of the case.
