IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH

CRM-M No.12138 of 2026 Date of Decision:-02.09.2026

Rinku …..Petitioner. Versus State of Haryana .....Respondent.

CORAM: HON’BLE MR. JUSTICE VIKRAM AGGARWAL ***** Present:- Mr. Aman Mehta, Advocate

for the petitioner.

Ms. Vasundhara Dalal Anand, Sr. DAG, Haryana.

VIKRAM AGGARWAL, J. (ORAL)

This is the second petition preferred under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) for the grant of regular bail to the petitioner in case FIR No.168, dated 07.09.2025 registered at Police Station Sadar Ratia, District Fatehabad, under Section 21(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’) (Sections 29 and 27-A of the NDPS Act added later on), the first bail application having been withdrawn on 23.12.2025 (Annexure P-5).

2. Status report by way of affidavit of Ms. Divyanshi Singla, Assistant Superintendent of Police, Ratia, District Fatehabad, filed in the YAG DUTT

Registry and the custody certificate dated 31.08.2026 filed in Court today, are taken on record. The Registry is directed to tag the same at an appropriate place on the case file.

3. On 07.09.2025, on the basis of a secret information, one car was intercepted. There were 04 occupants namely Rinku (present petitioner), Sandeep, Roop Singh and Soni. From the personal search of the petitioner, 150 grams of heroin (intermediate quantity) is alleged to have been recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that the petitioner is in custody for the last almost 01 year, he having been arrested on 07.09.2025; no recovery has to be made from him; investigation has been completed; final report has been submitted; charges have been framed, but out of 17 prosecution witnesses, only 01 has been examined; trial will still take a sufficiently long time and, therefore, no useful purpose would be served by keeping the petitioner in custody any longer.

5. Per contra, learned State counsel has opposed the prayer for the grant of regular bail, stating that the antecedents of the petitioner are not clean as he is involved in 07 other cases.

6. To this, learned counsel for the petitioner submits that in all other cases, the petitioner had been falsely implicated, as a result of which, he was acquitted in 04 cases and is on bail in the remaining 03 cases in which also, he had been nominated as an accused on the basis of disclosure statements.

7. I have considered the submissions made by learned counsel for the parties.

8. An intermediate quantity of heroin is alleged to have been YAG DUTT

recovered from the petitioner. He is in custody for the last almost 01 year now. Pendency of other cases per se would not act to the detriment of the petitioner keeping in view his custody for almost 01 year in the present case. Investigation has been completed. Final report has been submitted. charges have been framed, but out of 17 prosecution witnesses, only 01 has been examined till date. It is, thus, evident that the trial will still take a sufficiently long time and, therefore, no useful purpose would be served by keeping the petitioner in custody any longer.

9. In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate.
