3. The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. He is not named in the FIR but has been nominated as an accused later. As the petitioner is a first time offender, is in custody since 04.08.2025 but only 02 of the 19 prosecution witnesses have been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of regular bail.

4. The learned counsel for the State, on the other hand, contends that the petitioner is the sole accused having inflicted an injury attracting Section 307 IPC (Section 109 BNS) on the head of the complainant. He has been duly identified in the Test Identification Parade in the presence of a Magistrate. The nature of allegations levelled against and the evidence in support thereof, does not entitle him to the concession as prayed for. He, however, concedes that the petitioner is in custody since 04.08.2025 but only 02 of the 19 prosecution witnesses have been examined so far.

5. I have heard the learned counsel for the parties.

7. Thus without commenting on the merits of the case, the present petition is allowed and the petitioner-Anand Singh is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned.
