1. This petition has been filed under Article 226 of the Constitution of India praying for issuance of a writ in the nature of habeas corpus seeking directions to respondents to produce the detenue who has illegally been detained and confined by respondents No.4 and 5 and further seeking directions to appoint a Warrant Officer.

2. The report of the learned Chief Judicial Magistrate, Karnal, has been furnished in Court and the same is taken on record.

3. The detenue, namely Yukti, aged about 23 years, was produced before the learned Chief Judicial Magistrate, Karnal, who recorded her statement. A perusal of the said statement reveals that the detenue is a major and has expressed her unequivocal willingness to reside with Satish-petitioner. She has also stated that she is taking such decision voluntarily and of her own free will.

4. Since the detenue is admittedly a major, she is competent to make a choice with regard to her residence and the person with whom she wishes to reside. There is nothing on record to suggest that her decision is the result of any coercion, threat or undue influence.
