CORAM:

HON’BLE MR. JUSTICE JASJIT SINGH BEDI Present: Ms. Jasleen Chahal, Advocate, as Amicus Curiae for the petitioner. Mr. Roshandeep, AAG, Punjab. ***** JASJIT SINGH BEDI,

J. (Oral)

The prayer in the present petition under Section 483 BNSS (Section 439 Cr.P.C.) is for the grant of regular bail to the petitioner in case FIR No.199 dated 28.07.2023 under Sections 22 of the NDPS Act, (Act No.61) of 1985 registered at Police Station Patran, District Patiala.

2. The learned counsel for the petitioner contends that three persons namely, Akashdeep Singh @ Akash, Gulab Singh and Lovepreet Singh @ Labha were apprehended with 1130 intoxicant tablets. As the petitioner is in custody since 28.07.2023 and a co-accused/Akashdeep Singh @ Akash has been granted the concession of bail by this Court vide order dated 09.02.2026, the petitioner is also entitled to the same relief.

3. The learned counsel for the State, on the other hand, contends that the Trial is at its fag end and only 01 prosecution witness remains to be SUKHPREET KAUR 2026.08.27 17:53 I agree to specified portions of this document

CRM-M-13495-2025 ::2:: examined. Therefore, the petitioner ought not to be granted the concession as prayed for.

4. I have heard the learned counsel for the parties.

5. Admittedly, a co-accused of the petitioner has been granted the concession of bail. However, now only 01 prosecution witness remains to be examined and the next date of hearing before the Trial Court is 18.09.2026.

6. In view of the above, I do not deem it appropriate to grant the concession of bail to the petitioner. Therefore, the present petition stands dismissed.

7. The pending application(s), if any, shall stand disposed of accordingly. ( JASJIT SINGH BEDI) August 27, 2026
