1. This petition has been filed under section 483 B.N.S.S. (earlier 439 Cr.P.C.) for grant of regular bail in case FIR No. 50 dated 19.05.2025 under Section 22 of NDPS Act registered at Police Station- City Banga, District SBS Nagar (Nawan Shehar) Punjab.

2. The case of the prosecution is that 255 grams of heroin, which falls under the commercial quantity, was recovered from the possession of the petitioner without any licence, along with drug money amounting to Rs.7,000/-.

3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence. He further submits that the alleged recovery was not effected from the conscious possession of the petitioner. Rather, the police party allegedly recovered the contraband from a polythene bag lying in the bushes. It is argued that, as per the prosecution's own case, the petitioner had allegedly thrown the said polythene bag, and therefore, whether the bag recovered from the bushes RENU RAWAT 2026.08.19 13.10 I attest to the accuracy and integrity of this document Chandigarh was the same bag allegedly thrown by the petitioner is a debatable issue. The petitioner has been in custody since 19.05.2025 and prays for grant of regular bail.

4. Notice of motion.

5. Mr. Subhash Godara, Addl. Advocate General, Punjab, accepts notice on behalf of the respondent-State and vehemently opposes the prayer for grant of regular bail on the ground that the allegations against the petitioner are serious in nature. He has filed the custody certificate of the petitioner in Court today, which is taken on record. As per the custody certificate, the petitioner is in custody for the last 01 year 02 months and 27 days and is not involved in any other case. He further submits that all the prosecution witnesses have already been examined.

6. I have heard the submissions made by learned counsel for the parties and gone through the record.

7. Keeping in view the facts and circumstances of the case and having regard to the nature of allegations levelled against the petitioner, this Court finds that the alleged recovery of 255 grams of heroin falls within the ambit of commercial quantity, thereby attracting the rigours of Section 37 of the NDPS Act. It is further relevant to note that all the prosecution witnesses have already been examined and, therefore, no ground is made out for grant of regular bail to the petitioner. Consequently, the present petition is dismissed. 18.08.2026
