CRM-M-26598-2026 (O & M) ::4:: of earlier in-laws with interventional of respectable laws, and later on they refused to implement the compromise, and Satwinder Kaur was residing with her second husband Amarjit Singh in in-laws house (Ghosal) and during that Amarjit Singh connived with them, and started raising demand of money from the applicant, and he started extending the threats to kill both the children and due to his political reach and also to implicate in false cases, and started giving application, and the Amarjit Singh Udhowali and his father and family members also started giving threats, on 13.07.2019 they gave the name of the complainant in the newspaper and youtube, and tagged her name with SHO Gurdeep Singh Saini of that time P.S. 4. The learned counsel for the petitioner contends that, initially, the complainant-respondent No.2/Satwinder Kaur (hereinafter to be known as ‘respondent No.2’) was inimical to SHO Gurdeep Singh Saini and had filed multiple complaints against him, but later, she came under his influence and withdrew those complaints. Then, she connived with the SHO Gurdeep chandigarh
CRM-M-26598-2026 (O & M) ::6:: Singh Saini and lodged multiple cases against the petitioner. A bare reading of the FIR would reveal prima facie no allegations of extortion. For the offences of defamation and criminal intimidation, the FIR could not have been registered. Apparently, Sections 384 and 385 IPC (Sections 308(2) and 308(3) of BNS) have been invoked with a motive to register an FIR by adding non-cognizable offences. The father of the petitioner, namely, Piara Singh filed a petition (CRM-M-48628-2023) for quashing where this Court quashed proceedings qua him vide order dated 19.08.2025 (Annexure P-12). As the case of the petitioner is on a similar footing, the FIR (Annexure P- 10), the final report ( Annexure P-11) and all the consequential proceedings arising therefrom are liable to be quashed qua the present petitioner as well.
5. I have heard the learned counsel for the petitioner.
6. A bare perusal of the FIR (Annexure P-10) would reveal clear and specific allegations against the petitioner of defamation and extortion/blackmailing. The said allegations stand substantiated from a video of a Press Conference held by the petitioner and Piara Singh against the respondent No.2 wherein he has levelled multiple allegations against her. Therefore, prima facie the offences in question are made out against the petitioner.
7. Piara Singh, the father of the petitioner had approached this Court by way of a petition bearing No.CRM-M-48628-2023 seeking quashing of the FIR and the challan qua him. The relevant extract of the chandigarh
CRM-M-26598-2026 (O & M) ::7:: order dated 19.08.2025 (Annexure P-12) passed in the aforesaid petition is as under:-
4. The learned counsel for the petitioner contends that the allegations of the petitioner making defamatory statements against respondent No.-2/Satwinder Kaur and circulating the same are baseless. There is no such video where the petitioner can be seen making any statement against the complainant/respondent No.2. The defamatory video, if any, is of Amarjit Singh alone. He, therefore, contends that the present FIR (Annexure P-1), report under Section 173 Cr.P.C. (Annexure P-2) and the consequential proceedings arising therefrom are liable to be quashed qua the petitioner.
5. The learned counsel for the State, on the other hand, while referring to the affidavit dated 31.01.2024 contends that the petitioner-Piara Singh and his son Amarjit Singh/co- accused had held a press conference against complainant- respondent No.2/Satwinder Kaur and had levelled false allegations that she had been indulging in illegal sale of intoxicating drugs. There were photographs and videos wherein the petitioner could be seen alongwith his son-Amarjit Singh levelling such allegations. However, on his having examined the record, he concedes that the video is only of Amarjit Singh giving a sound bite to an anchor to the effect that complainant-respondent No.2 was involved in the drug trade alongwith one DSP.
6. None had appeared on behalf of respondents No.2 despite service. Consequently, Mr. Arav Gupta, Advocate, had been appointed as an Amicus Curiae to represent respondent No.2 in this case. On examination of the record, the Amicus Curiae fairly concedes that there is no such video in the report chandigarh
CRM-M-26598-2026 (O & M) ::8:: under Section 173(2) Cr.P.C. where the petitioner can be seen making any defamatory statement against the complainant- respondent No.2. However, there is one video where Amarjit Singh can be seen making a statement pertaining to the complainant-respondent No.2.
7. I have heard the learned counsel for the parties.
8. The arguments of the learned counsel for the petitioner that the allegations levelled in the FIR and the report under Section 173(2) Cr.P.C. of the petitioner making defamatory statements is not borne out from the record as has been admitted not only by the learned State counsel but also by the Amicus Curiae, both of whom have equivocally stated that in the video which is a part of the report under Section 173(2) Cr.P.C. only Amarjit Singh is seen talking to a Journalist but not the petitioner. Therefore, apparently, no offence is made out qua the petitioner and the institution of the instant proceedings are nothing but an abuse of the process of the Court qua petitioner.
9. In view of the above discussion, the FIR No.0067 dated 17.07.2020 under Sections 484/485/506 and 500 IPC, registered at Police Station Singh Bhagwantpur, District Rupnagar (Annexure P-1), the report under Section 173(2) Cr.P.C. and all the consequential proceedings arising therefrom stand quashed qua the petitioner.
10. The pending application(s), if any, shall stand disposed of accordingly.
8. It is the pleaded case of Piara Singh that the allegations, if at all are with respect to his son-Amarjit Singh (present petitioner). The FIR (Annexure P-10) contains the allegations that the petitioner raised demands chandigarh
CRM-M-26598-2026 (O & M) ::9:: of money from the complainant and threatened to kill her children and implicate her in false cases. Further, the video recording is prima facie defamatory.
9. Keeping in view the aforementioned facts and circumstances, I find no merit in the present petition and the same stands dismissed.
10. However, it is made clear that the observations made in this order are only for the purpose of deciding this petition only and the Trial Court is free to adjudicate upon the matter on the basis of the evidence led before it uninfluenced by any such observations made.
11. The pending application(s), if any, shall stand disposed of accordingly. ( JASJIT SINGH BEDI) JUDGE July 30, 2026 sukhpreet Whether speaking/reasoned : Yes/No Whether reportable : Yes/No chandigarh
