CRM-M-23601 of 2026 O&M) 2 thereafter, on 23.03.2026, he was arrested and since then he was in judicial custody. Trial was still in progress and would take some time to conclude, therefore, petitioner be allowed the concession of bail.
4. Learned State counsel has filed status report by way of affidavit of Lalit Kumar, HPS, Deputy Superintendent of Police, Kalanwali District Sirsa and opposes the prayer for bail arguing that besides being declared proclaimed offender, petitioner was involved in 4 other cases and considering his conduct during trial, he did not deserve the concession of bail.
5. Petitioner who was declared a proclaimed offender on 02.01.2026, is in custody w.e.f. 23.03.2026 i.e. for the last more than 4 months. Out of total 12 prosecution witnesses, only 2 have been examined. Trial is not likely to conclude soon. Involvement of petitioner in other cases cannot, by itself, be a ground to decline bail.
6. Considering the period of incarceration and the fact that trial is likely to take sometime to reach its logical conclusion, no useful purpose would be served by detaining the petitioner in prison. Further deprivation of petitioner’s liberty is not warranted. In the facts and circumstances of the case, petitioner is ordered to be released on regular bail subject to his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate. All the pending miscellaneous applications, if any, stand disposed of.
