.…Respondent

CORAM: HON'BLE MR. JUSTICE VIKRAM AGGARWAL

Present: Mr. Shivpartap Singh Khattra, Advocate

*** VIKRAM AGGARWAL, J. (ORAL)

Prayer in the present petition preferred under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the ‘BNSS’) is for the grant of regular bail to the petitioner in case FIR No.0031 dated 15.09.2025 registered under Sections 419, 420, 467, 468, 471, 120-B IPC at Police Station Cyber Crime, District Patiala.

2. Custody certificate dated 24.07.2026 filed in Court today is taken on record.

3. On a complaint submitted by one Gurdarshan Singh, the FIR in question was registered. The allegations are that after forging the Aadhar Card and PAN Card of the complainant, the accused (Varun Kumar) got a loan of Rs.22 lakhs approved from HDFC Bank, ICICI Bank and Axis Bank and the said amount was also transferred to the account of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that the petitioner has no role to MANI KUMAR

play; no recovery has been made from the petitioner; petitioner is in custody for the last 3 months and 17 days; investigation stands completed; final report has been submitted; charges are yet to be framed; antecedents of the petitioner are clean; trial will take a sufficiently long time and no useful purpose would be served by keeping the petitioner in custody any longer. 4.1

Learned counsel for the petitioner further submits that co- accused Varun Kumar has been granted regular bail by this Court vide order dated 23.07.2026 passed in CRM-M-28448-2026 titled as ‘Varun Kumar Vs. State of Punjab and another’.

5. Per contra, learned State counsel has opposed the bail application, stating that the offence allegedly committed by the petitioner is serious in nature.

6. I have considered the submissions made by learned counsel for the parties.

7. The matter is based largely upon documentary evidence. As to whether, the petitioner was a part of the conspiracy or not shall be determined when the trial concludes. Co-accused Varun Kumar has already been granted regular bail by this Court vide order dated 23.07.2026 passed in CRM-M-28448-2026 titled as ‘Varun Kumar Vs. State of Punjab another’ Antecedents of the petitioner are clean; investigation stands completed; final report has been submitted but charges have not yet been framed. Trial will, therefore, take a sufficiently long time and in the considered opinion of this Court, no useful purpose would be served by keeping the petitioner in custody any longer.

8. In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his MANI KUMAR

furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate.

9. Pending application(s), if any, shall also stand disposed of.
