1. The present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 439 Cr.P.C.) seeking the grant of interim regular bail for a period of four weeks in case FIR No.50 dated 28.04.2026, registered under Sections 21(c) and 27(a) of the Narcotic Drugs and Psychotropic Substances Act, 1985, with Section 29 of the NDPS Act added later on, at Police Station Sarai Amanat Khan, District Tarn Taran, to enable the petitioner to take care of his mother, who has been advised to undergo surgery.

2. Learned counsel for the petitioner submits that the petitioner's mother is suffering from a serious kidney ailment and has been advised surgery. It is contended that the petitioner is required to make necessary arrangements for the surgery and to look after his mother during her treatment and post-operative care. It is further submitted that the petitioner's father is also suffering from medical problems and is not in a position to take care of his wife. On these grounds, prayer has been made for grant of interim regular bail for a limited period.

3. In terms of the order dated 16.07.2026 passed by this Court, learned State counsel, on instructions from the Investigating Officer, has produced the medical record of the petitioner's mother, including the Medical Certificate issued by Baba Budha Ji Charitable Hospital, Bir Sahib, Tarn Taran and the radiological report issued by Nijjar Scans & Diagnostic Centre Pvt. Ltd., Amritsar, which are taken on record. He submits that the medical condition of the petitioner's mother has been duly verified. It is further submitted that she has been diagnosed with a right ureteric stone which is causing gross hydronephrosis of right kidney and needs urgent surgical intervention.

4. I have heard learned counsel for the parties.

5. The medical record placed on record by the State supports the petitioner's plea that his mother requires surgery. The State has also verified her medical condition. Considering the nature of the illness and the limited relief sought by the petitioner to attend to his mother's surgery and post-operative care, this Court is of the opinion that the petitioner deserves to be granted interim regular bail for a limited period.

6. Accordingly, the present petition is allowed. The petitioner is ordered to be released on interim regular bail for a period of four weeks from the date of receipt of certified copy of this order, subject to his furnishing the requisite bail and surety bonds to the satisfaction of the learned Trial Court/Duty Magistrate concerned.

7. The petitioner shall surrender before the Jail Superintendent concerned immediately after the expiry of the aforesaid period of interim bail.
