1. The petition under Section 528 Bharatiya Nagrik Suraksha Sanhita, 2023, seeks the following reliefs:-

(i) Direction to official respondents to enquire into representation dated 14.07.2026 in a fair and impartial manner.

(ii) Direction to official respondents to submit status report in the representation.

(iii) Direction to official respondents to decide representation dated 14.07.2026 in a time bound manner.

2. Learned counsel for the petitioner submits that the office of elected Sarpanch of Gram Panchayat, Village Saidan Wala was vacated pursuant to order dated 08.01.2026 of the Election Tribunal, Ferozepur. The office fell within the Scheduled Caste reservation roster and eligible Scheduled Caste Panch submitted a representation requesting for appointment as Adhikari Panch, as per reservation policy. However, respondent authorities appointed respondent No.7 of general category as Adhikari Panch. Later on, during audit of Gram Panchayat accounts for the period 2019-2024, serious audit objections surfaced indicating financial irregularities involving approximatley Rs.6 lacs. Instead of initiating recovery proceedings, authorities remained inactive and later, the amount of Rs.6 lacs was deposited in the Panchayat account on 25.06.2025. Immediately thereafter, a sum of Rs.3,89,533/- was withdrawn on 03.07.2026 in the name of respondent No.7 and her husband. Thus, serious questions requiring investigation into the source of the funds, the misappropriation, legality of the resolution etc. arose. The police machinery was shielding the responsible persons and was not inclined to investigate the matter despite representation, Annexure P3.

3. Notice of motion to official respondents only.

4. Mr. Akash Yadav, AAG, Punjab, who is present in Court, accepts notice on behalf of official respondents and submits that representation, Annexure P3 addressed to Senior Superintendent of Police, Ferozepur and various other authorities was never received by the police, on which account no action was taken. He assures that representation Annexure P3, would now be looked into and processed as per law.

5. In the given facts and circumstances, the petition is disposed of with a direction to official respondents to decide representation dated 14.07.2026 (Annexure P3), in accordance with law, within a period of 1 month and take necessary action, if so required.

6. However, if, official respondents do not find any substance in the allegations levelled in the representation dated 14.07.2026 (Annexure P3), the petitioner shall be duly informed, as per mandate of law.

7. The petition stands disposed of.

8. Pending miscellaneous applications, if any, stand disposed of. (SHALINI SINGH NAGPAL)
