1. This petition has been filed under section 483 B.N.S.S. (earlier 439 Cr.P.C.) for grant of regular bail in case FIR No. 0016 dated 17.02.2025 under Sections 420, 465, 467, 468, 471 and 120-B of the Indian Penal Code, 1860 (corresponding to Sections 318(4), 336(3), 340(2), 336(2), 338 and 61(2) of the Bharatiya Nyaya Sanhita, 2023), registered at Police Station Civil Lines, Amritsar, District Amritsar.

2. The allegations against the accused persons, including the present petitioner, are that they, in connivance with each other, cheated the Court by furnishing fake surety bonds on the basis of forged and fabricated documents for securing the release of co-accused Tejinder Singh from custody. The present applicant allegedly identified accused Tejinder Singh and also identified the affidavit furnished by surety Manjit Kaur. During investigation, certain RENU RAWAT

Chandigarh documents allegedly used in the commission of the offence were taken into possession by the investigating agency.

3. Learned counsel for the petitioner submits that the main accused in the present case is co-accused Tejinder Singh and that the petitioner neither furnished any bail bond nor any surety bond for securing his release. It is further submitted that the petitioner had only identified Manjit Kaur, who had furnished the surety bond on the basis of the Aadhaar Card produced by her, and the petitioner had no knowledge of any alleged forgery or fraud committed in the present case. Learned counsel further submits that the petitioner is in custody for last 01 year 03 months and 14 days. It is further submitted that the co-accused namely Manjit Kaur in the present case has already been granted the concession of regular bail. Therefore, the petitioner also deserves to be extended the benefit of bail on the ground of parity.

4. Notice of motion.

5. Mr. Subhash Godara, Addl. Advocate General, Punjab accepts notice on behalf of the respondent-State. He has opposed the prayer for grant of regular bail on the ground that the petitioner is involved in 07 other cases involving similar allegations. However, it is fairly stated that the petitioner has been granted the concession of bail in all those cases. He has filed the custody certificate of the petitioner in Court today, which is taken on record. As per the custody certificate, the petitioner is in custody for the last 01 year 03 months and 14 days.

6. I have heard the submissions made by the parties and gone through the record. RENU RAWAT

7. After hearing the rival contentions and considering the fact that the petitioner is in custody for the last 01 year 03 months and 14 days; co-accused has already been granted concession of regular bail coupled with the fact that the trial is likely to take considerable time, this Court is of the view that no useful purpose would be served by further incarceration of the petitioner. Accordingly, the petitioner is granted the concession of regular bail during the pendency of the trial.

8. Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.

9. Nothing discussed hereinabove shall be construed as an expression of opinion on the merits of the case.

10. It is clarified that if while on bail so granted through the instant order, the petitioner is found indulged in any other criminal case/activity, it shall be open to the State to seek cancellation of his bail. 27.07.2026
