2. Custody certificates dated 22.07.2026 filed in Court today, are taken on record.

3. As per the case of the prosecution, on 19.08.2025, a secret information was received by a police party which was present at Village Thriewal in connection with patrolling and search of bad elements. As per the secret information, Gurpreet Singh @ Gopi, Bikramjit Singh and Rinku had formed a gang and were indulging in smuggling of illegal weapons. It was informed that they were in possession of illegal weapons and that they were coming in a Scropio vehicle bearing Regn. No.PB-002-EZ-3772 along with certain other unidentified persons, who were travelling in a bolero vehicle. On the basis of the secret information, a raid was conducted. Whereas the occupants of the bolero vehicle fled from the spot, three persons including the petitioner were apprehended from the Scorpio vehicle. From each of the three persons, separate pistols along with live cartridges were recovered. Gurpreet Singh was found to be in possession of a Glock pistol along with 15 live cartridges. From the other two persons, including the petitioner, separate 9 mm along with 10 live cartridges each were recovered.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated. He further submits that the petitioners were arrested on 19.08.2025; almost one year has elapsed; no recovery has to be made from the petitioners; final report has been submitted; charges have YAG DUTT

been framed as far back as on 30.05.2026; co-accused Bikramjit Singh has already been granted regular bail by this Court vide order dated 21.07.2026 passed in CRM-M No.12643 of 2026; trial will take a sufficiently long time and, therefore, no useful purpose would be served by keeping the petitioner in custody any longer.

5. Per contra, learned counsel representing the State has opposed the bail petition.

6. I have considered the submissions made by learned counsel for the parties.

7. No doubt, the allegations are serious. However, the fact remains that the petitioners are in custody since 19.08.2025. Investigation stands completed and final report has been submitted. Charges have been framed. Only official witnesses have to depose and, therefore, there is no apprehension of any threat to the witnesses. As to whether the petitioners were actually found to be in possession of arms and ammunition would be determined at the stage of trial. Co-accused Bikramjit Singh has already been granted regular bail by this Court vide order dated 21.07.2026 passed in CRM-M No.12643 of 2026. The trial will take a sufficiently long time to conclude and, therefore, no useful purpose would be served by keeping the petitioners in custody any longer.

8. In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, the present petitions are allowed. The petitioners are ordered to be released on regular YAG DUTT

bail on their furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate.
