preferred under Section 483 of 23 (for short the ‘BNSS’) is for r in case FIR No.131 dated i)(c) of NDPS Act (Section 29 Station Kaithal Sadar, District arned State counsel in Court is secution, on 06.06.2026, two d Ravi were apprehended by a phool patti was recovered from

them. They disclosed in their disclosure statements that they had purchased the said ganja phool patti from the petitioner as a result of which, the petitioner was arrested on 09.06.2026 and a sum of Rs.2,500/-, stated to be drug money, was allegedly recovered from him.

4. Learned counsel for the petitioner submits that the ganja phool patti, alleged to have been recovered from the co-accused, in fact is not a commercial quantity because the seeds and leaves should have been excluded. He submits that in any case, apart from the disclosure statement, there is no evidence against the petitioner. He submits that even otherwise, the contraband recovered is marginally above the limit for the commercial quantity which is 20 kgs. Learned counsel further submits that the petitioner is in custody for the last 1 month and 11 days; investigation stands completed; antecedents of the petitioner are clean; trial will still take a sufficiently long time and no useful purpose would be served by keeping the petitioner in custody any longer.

5. Per contra, learned State counsel has opposed the bail application stating that the offence allegedly committed by the petitioner is serious in nature.

6. I have considered the submissions made by learned counsel for the parties.

7. The petitioner was arrested in the present FIR only on the basis of a disclosure statement. No other evidence is there at this stage linking him with the crime. Even otherwise, the antecedents of the petitioner are clean; investigation stands completed; trial will take a

sufficiently long time and, therefore, no useful purpose would be served by keeping the petitioner in custody any longer.

8. In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate.
