2. On 08.05.2026, the following order was passed: “Learned Counsel appearing on behalf of the petitioner contends that the allegations levelled in the petition carved out an offence against Kapil, who is employed as an Accountant with the complainant firm. As per the procedure followed, the payment received by any of the persons through his scanner had to be remitted to the Accountant Kapil who was ordained with the responsibility of making the deposits into the Accounts of the complainant. It is submitted that the failure to deposit the amount was on the part of Kapil and not on part of the petitioner. He further contends that he is ready and willing to extend all cooperation, and lawful explanation and furnish proof of remittances that have been transferred to Kapil. He submits that the petitioner has clean antecedents. He further contends that the petitioner is ready and willing to join the investigation as and when required by the Investigating Agency. Notice of motion. Ms. Gagandeep Kaur, DAG, Punjab appears and accepts notice on behalf of respondent-State and prays for some to file reply, if so advised. To come up on 22.07.2026, for further consideration.

Reply, if any, be filed in the meanwhile with copy in advance to the Counsel opposite. In the meantime, the petitioner is directed to join investigation as and when required by the Investigating Agency. In the event of petitioner joining investigation, he shall be admitted to interim bail by the arresting officer/investigating officer on furnishing of bail bonds by him to the satisfaction of the arresting officer/investigating officer. The petitioner shall also abide by the conditions as specified under Section 482 of the BNSS, 2023.”

3. Learned State counsel (on instructions) has submitted that the petitioner has joined investigation but his custodial interrogation is required for effecting the recovery of money in question.

3.1. Learned counsel for the complainant has vehemently opposed the grant of anticipatory bail to the petitioner by arguing that allegations

raised against the petitioner are serious in nature and in case the petitioner is extended the concession of anticipatory bail, there is all the likelihood that he may interfere with the investigation as also intimidate the witnesses and also the FIR-complainant.

4. Having heard learned counsel for the rival parties and upon perusal of the record; especially keeping in view the factum of the petitioner having joined investigation & cooperated therein, except for recovery of money in question; this Court is inclined to confirm the order dated 08.05.2026. Accordingly, petition is allowed and order dated 08.05.2026 is hereby made absolute.

5. This order should not be treated as “blanket” order. It will not be read granting petitioner indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence.

6. Liberty is reserved in favour of State/complainant to move for cancellation/recall of this order in case the petitioner violates any condition stipulated under Section 482(2) of BNSS or upon showing any other sufficient cause.

7. Needless to say that anything observed herein above shall not be construed to be an opinion on the merits of the case.

8. Pending application(s), if any, shall also stand disposed off.
