216 IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH

CRM-M No.34808 of 2026 Date of Decision:-22.07.2026

Jakir Hussain …..Petitioner. Versus State of Haryana .....Respondent.

CORAM: HON’BLE MR. JUSTICE VIKRAM AGGARWAL ***** Present:- Mr. Anas Ahmed, Advocate

for the petitioner.

Ms. Vasundhara Dalal Anand, Sr. DAG, Haryana.

VIKRAM AGGARWAL, J. (ORAL)

Prayer in the present petition preferred under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) is for the grant of anticipatory bail to the petitioner in case FIR No.167 dated 30.05.2026 registered under Section 325 of the Bharatiya Nyaya Sanhita, 2023 and Sections 3, 13(1), 8 and 13(3) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015, at Police Station Hathin, District Palwal.

2. On 26.06.2026, the following order was passed by a Coordinate Bench:- “Through the instant petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), prayer is made for grant of 'anticipatory bail' to the petitioner in case FIR no.167, dated 30.05.2026 (Annexure P-1), under Section YAG DUTT

CRM-M No.34808 of 2026 -2-

325 of BNS (Section 428 of IPC) and Section 3, 13(1), 8, 13(3) of Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 of the IPC, registered at Police Station Hathin, District Palwal.

Learned counsel for the petitioner in asking for the relief (supra), submits that in the FIR (supra) accused is shown to be as one Jakir son of Fajruddin, whereas, the petitioner is Jakir Hussain son of Hameeda, which itself creates a serious doubt regarding the identity and involvement of the petitioner in the alleged offence.

He further submits that the instant FIR has been registered only on a secret information, and there is no incriminating evidence with the prosecution to connect the petitioner with the alleged crime.

Finally, he submits that that the petitioner is a person of clean antecedents, and as on today, he is not involved in any other criminal case. Further, the petitioner is ready and willing to join the investigation to extend his co-operation in the ongoing investigation process.

Notice of motion.

Mr. Kapil Bansal, DAG, Haryana, accepts notice on behalf of respondent-State, and waives service.

Adjourned to 22.07.2026.

In the meantime, the petitioner is directed to join the investigation and to appear before the investigating agency, as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 482(2) of the B.N.S.S., 2023.”

3. Learned counsel for the petitioner submits that in compliance YAG DUTT

CRM-M No.34808 of 2026 -3-

of the aforesaid order dated 26.06.2026, the petitioner has duly joined investigation.

4. Learned State counsel, on instructions from HC Hakumudin, Police Station Hathin, who is present in the Court, submits that in compliance of the order dated 26.06.2026, though the petitioner has joined investigation, he has not fully cooperated as the instruments with which he had carried out the cow slaughter were not got recovered.

5. The objection raised by the State is hardly a ground for dismissal of the anticipatory bail application. Once the petitioner has joined investigation under the orders of the Court, mere non-recovery of instruments would not act to his detriment.

6. Keeping in view the aforesaid facts and circumstances, the present petition is allowed. The order dated 26.06.2026 is made absolute, subject to compliance of the provisions as envisaged under Section 482(2) of the BNSS.
