CRM-M-39150-2026 (O&M) (PHHC011151012026) Date of Decision: 20.07.2026 RAHUL

…Petitioner V/S STATE OF PUNJAB AND OTHERS …Respondents CORAM: HON’BLE MS. JUSTICE SHALINI SINGH NAGPAL Present: Mr. Anshul Sharma, Advocate and Mr. Lalit Shrma, Advocate for the petitioner. Mr. Kunwarbir Singh, AAG Punjab.

**** SHALINI SINGH NAGPAL

J. (Oral) The petition under Section 528 Bharatiya Nagarik Suraksha Sanhita, 2023 seeks following reliefs:

(i) direction to respondent No. 3 to conduct fair, impartial and effective investigation in FIR No. 116 dated 02.09.2025 under Sections 420, 406 Indian Penal Code, Police Station Fatehgarh Churian, District Gurdaspur;

(ii) direction to respondent No. 3 to consider and decide representation dated 02.11.2025 (Annexure P-4) moved by the petitioner; Learned counsel for the petitioner submits that petitioner was induced by Tejpreet Kaur, Rajwinder Kaur and their associates to transfer ₹15,00,000/- on false representation that they would procure a Canadian work permit for him. Believing their representation, petitioner made the payment and also handed over his original documents. However, neither work permit was arranged nor the amount was refunded. The matter was reported to the Police. Subject cited FIR was registered. Despite AJAY GOSWAMI 2026.07.21 14:07 I attest to the accuracy and integrity of this document

CRM-M-39150-2026 (O&M)

availability of cogent electronic and documentary evidence proving the complicity of Rajwinder Kaur, only Tejpreet Kaur was booked as an accused and Rajwinder Kaur was let off. In this regard, a representation (Annexure P-4) was moved to Director General of Police, Punjab, but no action was taken on the same. Learned counsel submits that at this stage, petitioner would be satisfied if appropriate direction is issued to the respondent No. 3- Senior Superintendent of Police, Ferozepur, to consider and decide representation dated 02.11.2025 (Annexure P-4) moved by petitioner and take necessary action thereupon in a time bound manner. Notice of motion to official respondents only. Mr. Kunwarbir Singh, AAG Punjab, who is present in Court, accepts notice on behalf of the official respondents and on instructions from ASI Shamsher Singh submits that investigation in the FIR in progress. Petitioner’s representation was received and the matter was being supervised by Superintendent of Police (Detective), Batala. Since the police is already investigating the matter and petitioner’s representation has already been looked into, no further directions are required to be issued. Respondent-State is, however, directed to expedite the investigation. Petition is disposed of on the aforesaid terms. Pending CRM(s), if any, also stand disposed of.
