1. **1.** The instant application is filed for early hearing of the appeal as the counsel for the appellant stated that the respondent no.1 has issued notice for taking possession of the subject property on 14.10.2026. Sh. Priyank Tiwari, Advocate for the appellant further stated that a sum of Rs.26 lacs shall be deposited before this Tribunal today itself in terms of order dated 01.10.2026 passed by this Tribunal. He also stated that the appellant is not seeking any relief against the respondents 2 and 3.
2. **2.** In view of the submissions made by the counsel for the appellant, let notice be issued to the respondent no.1 on taking steps by the appellant through all permissible modes returnable on 13.10.2026 subject to the deposition of Rs.26 lacs before this Tribunal today itself.
3. **3.** The date 13.11.2026 as already fixed stands cancelled.
