**DEBTS RECOVERY APPELLATE TRIBUNAL, DELHI**

Appeal No. 318/2026

In SA Dy No. 1492/2026 (DRT-II, Chandigarh)

Item No. 01

J & R Associates & Anr.

Vs.

Canara Bank & Anr.

**12.10.2026**

Present: Mr. Ruchir Batra, Ld. Counsel for Appellant (through VC)

This matter has been taken up by me through Hybrid Mode.

It is to state that the counsel for the appellant has referred to Diary Nos. 4657/2026 & 4658/2026, wherein the court fee in respect of Objection No.1 has been paid. Further, with respect to Objection no.3, the counsel for the appellant mentioned that the same shall be rectified today.

Further, with respect to the deficit court fee, it is mentioned by the counsel for the appellant that the court fee has been wrongly calculated on the basis of the sale notice dated 06.04.2026, wherein the liability of J & R Association, i.e., the appellant herein, is stated to be Rs.1,11,84,199.97/- (Rupees One Crore Eleven Lakh Eighty Four Thousand One Hundred Ninety Nine and Paisa Ninety Seven Only), and the liability of K S Enterprises is stated to be Rs.97,23,365.82/- (Rupees Ninety Seven Lakh Twenty Three Thousand Three Hundred Sixty Five and Paisa Eighty Two Only).

It is further mentioned by the counsel for the appellant that K S Enterprises has filed a separate SA, which is still pending before the DRT. Therefore, the said amount cannot be taken into consideration for the purpose of calculating the court fee payable by the present appellant.

Heard counsel for the appellant and perused the record. It is noted that, as per the demand notice dated 14.01.2026, the amount payable by the appellant herein is Rs. 1,11,84,199.97/-. Accordingly, the court fee is required to be calculated on the said amount.

Hence, the court fee shall be recalculated on the aforesaid amount, and the Registry shall verify whether any deficit in court fee remains.

In view of the above, and considering the urgency expressed by the counsel for the appellant, the matter is re-listed on 13.10.2026 for compliance by the appellant.
