DEBTS RECOVERY TRIBUNAL-I, CHANDIGARH

MA/3/2026 IN NDN/1106/2024 (OA) JAMMU AND KASHMIR BANK LIMITED Vs NAZIR ELECTRICAL ENGINEERING WORKS

17.01.2026 Item No.46

Present: Mr. Mayank Mathur & Mr. Gaurav Thakur, Counsel for the Applicant Bank.

None for the defendants.

MA No. 03 of 2026

Heard on the application for rectification of the order dated 10.10.2025 passed by this Tribunal in NDN/1106/2024 (OA). It is stated that this OA was wrongly filed before this Tribunal. In fact, the jurisdiction for the same vests with the Civil Court as the debt to be recovered was less than Rs. 20 lacs. It appears that the order has been passed inadvertently. Accordingly, the order dated 10.10.2025 is hereby recalled. It is made clear that the bank would be at liberty to file/pursue any remedy which may be permissible under the law. Registrar would refund the court fees as per rules. The MA stands disposed of. File be consigned to the record room after due compliance.

(A S Narang) Presiding Officer DRT-I, Chandigarh
